INVOLVEMENT OF TAX IN EXEMPT SALE OR SUPPLY


मित्रो!
      माल और सेवाओं की बिक्री या सप्लाई पर कर बसूली की वैट या जीएसटी व्यवस्था के अंतर्गत कर मुक्त बिक्री या सप्लाई किये जाने वाले माल और सेवाओं के मूल्य में पूर्व में अदा किये गए कर का अंश शामिल रहता है। यह वह कर होता है जो बिक्री या सप्लाई किये जा रहे माल या सेवा के निर्माण या उत्पादन में प्रयुक्त सेवाओं या माल पर पूर्व में भुगतान किया जा चुका होता है। जहां कर मुक्त माल पैकिंग मैटेरियल में सप्लाई किया जाता है वहां पर बिक्रेता पैकिंग मैटेरियल खरीदते समय कर का भुगतान करता है।
      उदहारण के लिए नमक की बिक्री या सप्लाई बिक्री कर या जीएसटी से मुक्त है किन्तु आयोडाइज्ड नमक के उत्पादन में प्रयुक्त होने वाली मशीनों, निर्माण में प्रयुक्त आयोडीन, पैकिंग मैटेरियल आदि की निर्माता द्वारा खरीद पर दिए गए कर की बसूली भी नमक के मूल्य से ही होती है। इस प्रकार कर मुक्त नमक के बिक्रय मूल्य में भी कर का अंश होता है।

Under VAT or GST system of payment of tax on sale or supply of goods or services, value of goods or services the sale or supply of which is exempt from tax, includes certain amount of tax already paid on goods and services utilised in manufacture or production of goods the sale or supply of which is exempt.

                We take example of Iodized salt. Sale or supply of salt is exempt from levy of tax. A manufacturer of Iodized salt need machinery, equipment, Iodine, packing material, etc. While making purchase of these things, manufacturer has to pay tax. Recovery of amount of tax, paid on purchase of these things, is also made from sale price of salt. Thus sale price of salt includes part of the amount of tax paid on things utilized in making salt and supply or sale of salt.

GST : A SUPPLY LEVIABLE TO TAX
कर से उद्गृहणीय प्रदाय
मित्रो !
    किसी भी अधिनियम को एक single piece of legislation मानकर पढ़ा जाता है। किसी टैक्स से सम्बंधित अधिनियम में टैक्स की लेवी के लिए तीन  विन्दुओं पर घोषणा किया जाना अनिवार्य  होता है।
1. टैक्स किस इवेंट, यथा आय, माल की बिक्री, माल की खरीद, माल की सप्लाई, सेवाओं की सप्लाई, माल का अंतरण, आदि, पर कर लेवी किया जायेगा।
2. कर लेवी का आधार क्या होगा यथा  मूल्य का प्रतिशत, प्रति किलो ग्राम, प्रति लीटर, प्रति मीटर आदि।
3. व्यक्ति जो टैक्स की धनराशि का भुगतान करेगा और स्वतः टैक्स का भुगतान न करने पर ऐसे व्यक्ति से टैक्स की वसूली की जाएगी।  
    यदि इनमें से किसी एक विन्दु पर घोषणा नहीं की गयी है तब टैक्स लेवी किया गया है ऐसा नहीं माना जा सकता है। टैक्स से तात्पर्य जनता के प्रयोजनों के लिए सरकार द्वारा कानून द्वारा प्रवर्तनीय प्रक्रिया के अंतर्गत जनता से धन की अनिवार्य रूप से उगाही से होता है।
    जहां किसी टैक्स लॉ में इस प्रकार प्राविधान बनाये गए हों जिनके अनुपालन में अंततः उगाही योग्य धनराशि अनिश्चय हो या फिर शून्य हो वहां टैक्स लेवी किया जाना नहीं माना जा सकता है। ऐसा निम्नलिखित परिस्थितियों में हो सकता है।
1. कर की दर शून्य (zero) या निल (nil) निर्धारित की गयी हो; अथवा
2. कर अधिनियम में एक प्राविधान टैक्स लगाने का हो किन्तु दूसरा प्राविधान करमुक्ति (exemption) दिए जाने का हो; अथवा
3. कर अधिनियम में एक प्राविधान कर लगाने का हो किन्तु दूसरा प्राविधान कर राशि कर दाता को बापस किये जाने (Refund) का हो; अथवा
4. कर अधिनियम में एक प्राविधान कर लगाने का हो किन्तु दूसरा प्राविधान कर राशि का रिबेट (Rebate) दिए जाने का हो।
    ऐसे प्राविधान जिन संव्यवहारों पर लागू होते हैं उनके सम्बन्ध में सभी कार्यवाही करने पर न तो करदाता पर कोई कर का बोझ पड़ता है और न ही सरकार को कोई राजस्व मिलता है। स्पष्ट है इन संव्यवहारों को टैक्स लेवी क्लॉज में शामिल किये जाने के बाबजूद इन पर कोई कर नहीं लगाया गया होता है।  ऐसे संव्यवहारों के टर्नओवर को टैक्स tax payer पेयर के सकल टर्नओवर में तो शामिल किया जा सकता है किन्तु ऐसे टर्नओवर को कर योग्य टर्नओवर में शामिल नहीं किया जा सकता है।
    ऐसा सोचना कि जिन संव्यवहारों के लिए कर की दर शून्य या निल (nil) निर्धारित है, उन पर कर उदग्राह्य (leviable) है क्योंकि कर की दर में संशोधन करके कर लगाया जा सकता है, उचित नहीं है। क्योंकि कानून में संशोधन किसी भी प्राविधान में किया जा सकता है, संशोधन की अपेक्षा में, संशोधन हो गया मानकर निर्णय नहीं लिया जा सकता है। Dictionary meanings और Glossary of legal terms के अनुसार zero और nil शब्द एक-दूसरे के पर्याय हैं। दोनों दरों पर कर निर्धारित करने से कोई राजस्व प्राप्त नहीं हो सकता है।
    कर योग्य और करमुक्त को लेकर माननीय सुप्रीम कोर्ट की संविधान पीठ ने सर्वश्री ए. वी. फर्नांडीज़ वनाम दि स्टेट ऑफ़ केरल, निर्णय दिनांक अप्रैल 02, 1957 में निम्नप्रकार महत्वपूर्ण व्यवस्था दी है :-
"There is a broad distinction between the provisions contained in the statute in regard to the exemptions of tax or refund or rebate of tax on the one hand and in regard to the non-liability to tax or non-imposition of tax on the other. In the former case, but for the provisions as regards the exemptions or refund or rebate of tax, the sales or purchases would have to be included in the gross turnover of the dealer because they are prima facie liable to tax and the only thing which the dealer is entitled to in respect thereof is the deduction from the gross turnover in order to arrive at the net turnover on which the tax can be imposed. In the latter case, the sales or purchases are exempted from taxation altogether. The Legislature cannot enact a law imposing or authorising the imposition of a tax thereupon and they are not liable to any such imposition of tax. If they are thus not liable to tax, no tax can be levied or imposed on them and they do not come within the purview of the Act at all. The very fact of their non- liability to tax is sufficient to exclude them from the calculation of the gross turnover as well as the net turnover on which sales tax can be levied or imposed."
     यहां पर माननीय उच्चतम न्यायलय ने दो तरह के करमुक्ति से सम्बंधित संव्यवहारों में अंतर किया है। एक प्रकार के ऐसे संव्यवहार हैं जिन पर कर लगाए जा सकने का अधिकार अधिनियम में प्राप्त नहीं है अर्थात ऐसे संव्यवहारों को अधिनियम से बाहर रखा गया है। उदहारण के लिए जीएसटी में Alcoholic liquor for human consumption की सप्लाई को बाहर रखा गया है, अस्थाई तौर पर Petroleum Crude, Diesel Oil, Petrol, Natural Gas और Aviation Turbine Fuel (ATF)  को भी जीएसटी से बाहर रखा गया है। ऐसे संव्यवहारों के टर्नओवर को अधिनियम के अधीन कुल टर्नओवर में भी शामिल नहीं किया जा सकता है। 
     माननीय उच्चतम न्यायलय के अनुसार दूसरे प्रकार की करमुक्ति वह होती है जिसके सम्बन्ध में अधिनियम में  exemption, refund  या rebate का प्राविधान उपलब्ध होता है। जिन संव्यवहारों के सम्बन्ध में exemption, refund या rebate के प्राविधान होते हैं उन संव्यवहारों के टर्नओवर को सकल टर्नओवर (Gross turnover) में शामिल किया जा सकता है किन्तु करयोग्य टर्नओवर (net turnover) में शामिल नहीं किया जा सकता है। करयोग्य टर्नओवर ऐसे संव्यवहारों के मूल्यों का योग होता है जिन पर कर उदग्राह्य ( aggregate of values of transactions leviable to tax) होता है।







  

कर भुगतान की कानूनी बाध्यता होती है : There is legal obligation to pay tax

करदाता कर भुगतान के लिए बाध्य होता है
मित्रो !
If any supply of goods or services is leviable to tax, tax payer cannot be given an option for payment of tax levied.
    यदि किसी माल या सेवाओं की सप्लाई पर कर उदग्रहाय (leviable)  है तब करदाता कर की धनराशि का भुगतान करने के लिए बाध्य (under obligation) होता है, उसको यह विकल्प उपलब्ध नहीं होता कि वह कर का भुगतान करे अथवा न करे।  क्योंकि -
"It is said that the essence of taxation is compulsion, that is to say, it is imposed under statutory power without the taxpayer’s consent and the payment is enforced by law".

"ऐसा कहा जाता है कि कराधान का सार मजबूरी है, जिसका अर्थ है, यह करदाता की सहमति के बिना वैधानिक शक्ति के तहत लगाया जाता है और भुगतान कानून द्वारा लागू होता है"।
     जिस धनराशि के सम्बन्ध में भुगतान करने या न करने का विकल्प उपलब्ध हो वह धनराशि कर की धनराशि नहीं हो सकती।
IGST Act में निम्नलिखित प्राविधानों का अवलोकन करना चाहें।

धारा 5 की उपधारा (1)
Levy and collection.
5. (1) Subject to the provisions of sub-section (2), there shall be levied a tax called the integrated goods and services tax on all inter-State supplies of goods or services or both, except on the supply of alcoholic liquor for human
consumption, on the value determined under section 15 of the Central Goods and Services Tax Act and at such rates, not exceeding forty per cent, as may be notified by the Government on the recommendations of the Council and collected in such manner as may be prescribed and shall be paid by the taxable person:
Provided that the integrated tax on goods imported into India shall be levied and collected in accordance with the provisions of section 3 of the Customs Tariff Act, 1975 (51 of 1975) on the value as determined under the said Act at the point when duties of customs are levied on the said goods under section 12 of the Customs Act, 1962 (52 of 1962).
Inter-State Supply
धारा 7 की उपधारा (5)
(5) Supply of goods or services or both,—
(a) when the supplier is located in India and the place of supply is outside India;
(b) to or by a Special Economic Zone developer or a Special Economic Zone unit; or
(c) in the taxable territory, not being an intra-State supply and not covered elsewhere in this section,
shall be treated to be a supply of goods or services or both in the course of inter-State trade or commerce.
(किन्हीं कारणों से मैं यह नहीं मानता कि धारा 7 की विभिन्न उपधाराओं में "inter-State supply" परिभाषित है। सरकार ऐसा मानती है।) 
Zero-rated supply
धारा 16 की उपधारा (3)
(3) A registered person making zero rated supply shall be eligible to claim refund under either of the following options, namely:—
(a) he may supply goods or services or both under bond or Letter of Undertaking, subject to such conditions,  safeguards and procedure as may be prescribed, without payment of integrated tax and claim refund of unutilised input tax credit; or
(b) he may supply goods or services or both, subject to such conditions, safeguards and procedure as may be  prescribed, on payment of integrated tax and claim refund of such tax paid on goods or services or both supplied,
in accordance with the provisions of section 54 of the Central Goods and Services Tax Act or the rules made thereunder.
     यहाँ क्लॉज (a) में बिना टैक्स दिए जीरो-रेटेड सप्लाइज करने की बात कही गयी है तथा क्लॉज (b) में टैक्स का भुगतान करने के बाद रिफंड लेने की बात कही गयी है।

     मेरा यह मानना है कि जिन सप्लाइज के सम्बन्ध में धारा 16 की उपधारा (3) बनाई गयी है वे सप्लाइज धारा 16 की उपधारा (1) में ज़ीरो-रेटेड सप्लाइज (Zero-rated supplies) घोषित कर दिए जाने पर सप्लाइज leviable to tax नहीं रह गयीं हैं।
