शून्य दर पूर्ति : Zero rated supply


मित्रो!
एकीकृत माल और सेवा कर अधिनियम की धारा 16 अथवा जीएसटी कानूनों में अन्य स्थानों पर  प्रयुक्त अथवा संदर्भित पद "शून्य दर पूर्ति" (Zero rated supply) का प्रयोग भ्रम की स्थिति उत्पन्न करता है। इसका सामान्यतः समझी जाने वाली "Zero rated supply" से कोई सम्बन्ध नहीं है और न ही इसका सम्बन्ध कर की दर अथवा सप्लाई की कर देयता से है।

एकीकृत माल और सेवा कर अधिनियम की धारा 16 की उपधारा (1) में पद "शून्य दर पूर्ति" (Zero rated supply) को निम्न प्रकार परिभाषित किया गया है:
16. (1) ‘‘शून्‍य दर पूर्ति’’ से माल या सेवाओं या दोनों की निम्‍नलिखित कराधेय पूर्तियां अभिप्रेत हैं, अर्थात् :--
(क)     माल या सेवा या दोनों का निर्यात ; या
(ख)    किसी विशेष आर्थिक जोन विकासकर्ता या किसी विशेष आर्थिक जोन इकाई को माल या सेवाएं या दोनों की पूर्ति।
इस धारा की उपधाराएं (2) व (3) निम्नवत हैं:
(2) केंद्रीय माल और सेवा कर अधिनियम की धारा 17 की उपधारा (5) के उपबंधों के अध्यधीन शून् दर पूर्तियां करने के  लिए इनपुट कर का प्रत्‍यय इस बात के होते हुए भी प्राप्‍त किया जा सकेगा कि ऐसी पूर्ति कोई छूट प्राप्‍त पूर्ति हो सकेगी ।
(3) माल या सेवा या दोनों का निर्यात करने वाला रजिस्ट्रीकृत कोई व्यक्ति केंद्रीय माल और सेवा कर अधिनियम की धारा 54 और उसके अधीन बनाए गए नियमों के उपबंधों के अनुसार निम्नलिखित विकल्पों में किसी के अधीन प्रतिदाय का दावा करने का पात्र होगा, अर्थात् :--
(क)                     वह एकीकृत कर के संदाय बिना ऐसी शर्तों, रक्षापायों और प्रक्रिया के अध्यधीन, जो विहित किए जाएं, बंधपत्र या वचनबंध पत्र के अधीन माल या सेवाओं या दोनों का निर्यात कर सकेगा और अनुपयोजित इनपुट कर प्रत्यय के प्रतिदाय का दावा कर सकेगा ; या
(ख)                     वह पूर्ति किए गए माल या सेवाओं या दोनों पर एकीकृत कर के संदाय पर ऐसी शर्तों, रक्षापायों और प्रक्रिया के अध्यधीन, जो विहित किए जाएं, माल या सेवा या दोनों का निर्यात कर सकेगा और ऐसे संदत्
कर के प्रतिदाय का दावा कर सकेगा
     अगर हम पद "शून्य दर पूर्ति" (Zero rated supply) के स्थान पर पद "विशिष्ट श्रेणी पूर्ति" (Special category supply) सभी जगह रख दें तो हम देखते हैं कि कर देयता या इनपुट टैक्स क्रेडिट या बापसी (refund) सम्बन्धी प्राविधानों में कोई प्रभाव नहीं पड़ता। जाहिर है कि पद "शून्य दर पूर्ति" का कोई कर देयता या इनपुट टैक्स क्रेडिट या बापसी के प्राविधानों पर कोई प्रभाव नहीं है। पद "शून्य दर पूर्ति" का प्रयोग दो प्रकार की पूर्तियों को संदर्भित करने मात्र के लिए किया गया है।
      उपधारा (2) में शब्दों "ऐसी पूर्ति कोई छूट प्राप्त पूर्ति हो सकेगी।" के प्रयोग से स्पष्ट है कि "शून्य दर पूर्ति" के छूट प्राप्त पूर्ति होने की स्थिति में भी इनपुट टैक्स क्रेडिट का लाभ अनुमन्य होगा। इसका आशय यह हुआ कि शून्य दर पूर्ति  कर योग्य और कर मुक्त दोनों प्रकार की हो सकती है।  यदि शून्य दर पूर्ति का आशय ऐसी सप्लाई से रहा होता जिस पर कर की दर शून्य रही होती तब सभी शून्य दर पूर्तियाँ कर मुक्त रही होतीं क्योंकि केंद्रीय माल और सेवा कर अधिनियम की धारा 2 के क्लाज (47) में शून्य दर आकर्षित करने वाली पूर्तियों को "छूट प्राप्त प्रदाय" (exempt supply) में शामिल किया गया है।

Is Zero-Rated Supply a taxable supply?

            Whether a Zero Rated Supply is a Taxable Supply, is an important question. For the reasons given hereunder, my personal opinion is that a zero-rated supply is not a taxable supply of goods or services or both for the purpose of goods and services tax (GST).
A.         Expression "taxable supply" has been defined in clause (108) of section 2 of the Central Goods and Services Tax Act, 2017 as follows:
'(108) “taxable supply” means a supply of goods or services or both which is leviable to tax under this Act;'
            This definition of expression "taxable supply" is also applicable to the provisions of the Integrated Goods and Services Tax Act, 2017 by virtue of clause (24) of section 2 of the said Act. It is to be noted that where any supply is leviable to any tax, such amount of tax is to be paid by the person specified in the tax levy provision of the Act.
B. In the draft of the Integrated Goods and Services Tax Act released on November 16, 2016, sub-section (1) of section 16 had run as follows:
16. Zero rated supply
"(1) “zero rated supply” means any of the following taxable supply of goods and/or services, namely -
(a) export of goods and/or services; or
(b) supply of goods and/or services to a SEZ developer or an SEZ unit."
            Here, after the word "following", expression "taxable supply of goods and/or services" had occurred. In the Integrated Goods and Services Tax Act, 2017, passed by the Parliament, sub-section (1) of section 16 of the said Act runs as follows:
"Zero rated supply.
16. (1) “Zero rated supply” means any of the following supplies of goods or services or both, namely:—
(a) export of goods or services or both; or
(b) supply of goods or services or both to a Special Economic Zone developer or a Special Economic Zone unit."
            Here we see that word "taxable", used in the draft, is missing. This is not an omission. The Goods and Services Tax Council, in its 12th meeting held on March 16, 2017, on suggestion from the Ministry of Commerce and Industry, Government of India, had taken a decision of including export supplies of alcoholic liquor for human consumption, crude oil, high speed diesel, motor spirit (commonly known as petrol), natural gas and aviation turbine fuel and supplies of such goods in zero rated supply. These are the goods on supply of which goods and services tax (GST) cannot be levied in view of provisions of the Constitution. Since, zero rated supplies include supply of such goods, therefore, in respect of a zero rated supply, it cannot be said that supply is leviable to tax.
C. Sub-section (2) of section 16 of the Integrated Goods and Services Tax Act, 2017 runs as follows:
"(2) Subject to the provisions of sub-section (5) of section 17 of the Central Goods and Services Tax Act, credit of input tax may be availed for making zero-rated supplies, notwithstanding that such supply may be an exempt supply."
            Here we notice that the sub-section (2) clarifies that benefit of input tax credit shall also be available in respect of exempt supplies. Definition of expression "exempt supply", provided in clause (47) of section 2 of the Central Goods and Services Tax Act, 2017 is also applicable to the provisions of the Integrated Goods and Services Tax Act, 2017. This definition runs as follows:
'(47) “exempt supply” means supply of any goods or services or both which attracts nil rate of tax or which may be wholly exempt from tax under section 11, or under section 6 of the Integrated Goods and Services Tax Act, and includes non-taxable supply;'
            Non-taxable supply is nothing but supply of goods on the supply of which goods and services tax (GST) cannot be levied. This also clarifies that zero-rated supply includes supplies on which GST cannot be levied.

D. On zero-rated supply, goods and services tax is not payable. This is clear from the FAQ issued by the Central Board of Excise and Customs (CBEC). Also, no person is paying goods and services tax (GST) on zero rated supply and Government is accepting returns without any objection. It is noteworthy that levy of tax creates liability, of payment of certain amount of tax, of some person specified in the tax levy provision of the Act. If in respect of an event no person is liable for payment of any money as tax, event (here supply of goods or services or both) cannot be said an event leviable to tax i.e. a taxable supply.
            In view of the discussion above, I am of the view that a zero rated supply is not a taxable supply but benefit of input tax credit is admissible in respect of inputs and input services used in making such supply.

ZERO RATED SUPPLY OF GOODS OR SERVICES

      माल या सेवाओं की बिक्री या सप्लाई पर कर बसूली की वैट और जीएसटी व्यवस्थाओं के अंतर्गत 'जीरो रेटेड सप्लाई' केवल माल या सेवाओं की सप्लाई पर पर लगने वाले कर से ही मुक्त (exempt) नहीं होती बल्कि ऐसी सप्लाई के मूल्य में कर का कोई अंश नहीं रहता है। किसी सप्लाई को जीरो रेटेड सप्लाई करने के लिए सप्लाई कर लेवी (levy of tax) से मुक्त (exempt) रखी जाती है और सप्लायर द्वारा सप्लाई में प्रयोग करने के लिए प्राप्त किये गए माल और सेवाओं  पर दिए गए कर की धनराशि का उसे रिफंड मिल जाता है।
      यह ध्यान देने योग्य है कि माल की बिक्री या सप्लाई को कर मुक्त कर देने के बाद भी माल के बिक्री मूल्य में ऐसी कर की धनराशि शामिल रहती है जो बिक्रेता या सप्लायर द्वारा सप्लाई किये जाने वाले  माल के उत्पादन या निर्माण में प्रयोग करने के लिए आवश्यक माल और सेवाओं को प्राप्त करने अथवा सप्लाई किये जाने वाले माल की खरीद पर भुगतान की जाती है। इस प्रकार माल की सप्लाई को कर मुक्त कर देने पर माल का बिक्री मूल्य पूर्णरूपेण कर की धनराशि से मुक्त नहीं होता।

                Under GST or VAT, a 'Zero rated supply' of goods or services is not only a supply on which tax is not leviable but its value also does not contain any amount of tax.  Zero rated effect is given by exempting the supply from levy of tax and by allowing refund of amount of tax paid by the tax payer on procurement of goods and services utilised in making the supply.
                It is noteworthy that even after declaring a supply of goods or services exempt from levy of tax, value of goods sold or supplied does not become completely free from tax burden. Value of sale or supply includes the amount of tax paid by the supplier on procurement of goods or services utilised in manufacture or production of goods to be sold or supplied or in procurement of goods to be sold or supplied.

कर भुगतान की कानूनी बाध्यता होती है : There is legal obligation to pay tax

करदाता कर भुगतान के लिए बाध्य होता है
मित्रो !
If any supply of goods or services is leviable to tax, tax payer cannot be given an option for payment of tax levied.
    यदि किसी माल या सेवाओं की सप्लाई पर कर उदग्रहाय (leviable)  है तब करदाता कर की धनराशि का भुगतान करने के लिए बाध्य (under obligation) होता है, उसको यह विकल्प उपलब्ध नहीं होता कि वह कर का भुगतान करे अथवा करे।  क्योंकि -
"It is said that the essence of taxation is compulsion, that is to say, it is imposed under statutory power without the taxpayer’s consent and the payment is enforced by law".

"ऐसा कहा जाता है कि कराधान का सार मजबूरी है, जिसका अर्थ है, यह करदाता की सहमति के बिना वैधानिक शक्ति के तहत लगाया जाता है और भुगतान कानून द्वारा लागू होता है"
     जिस धनराशि के सम्बन्ध में भुगतान करने या न करने का विकल्प उपलब्ध हो वह धनराशि कर की धनराशि नहीं हो सकती।
IGST Act में निम्नलिखित प्राविधानों का अवलोकन करना चाहें।

धारा 5 की उपधारा (1)
Levy and collection.
5. (1) Subject to the provisions of sub-section (2), there shall be levied a tax called the integrated goods and services tax on all inter-State supplies of goods or services or both, except on the supply of alcoholic liquor for human
consumption, on the value determined under section 15 of the Central Goods and Services Tax Act and at such rates, not exceeding forty per cent, as may be notified by the Government on the recommendations of the Council and collected in such manner as may be prescribed and shall be paid by the taxable person:
Provided that the integrated tax on goods imported into India shall be levied and collected in accordance with the provisions of section 3 of the Customs Tariff Act, 1975 (51 of 1975) on the value as determined under the said Act at the point when duties of customs are levied on the said goods under section 12 of the Customs Act, 1962 (52 of 1962).
Inter-State Supply
धारा 7 की उपधारा (5)
(5) Supply of goods or services or both,—
(a) when the supplier is located in India and the place of supply is outside India;
(b) to or by a Special Economic Zone developer or a Special Economic Zone unit; or
(c) in the taxable territory, not being an intra-State supply and not covered elsewhere in this section,
shall be treated to be a supply of goods or services or both in the course of inter-State trade or commerce.
(किन्हीं कारणों से मैं यह नहीं मानता कि धारा 7 की विभिन्न उपधाराओं में "inter-State supply" परिभाषित है। सरकार ऐसा मानती है।) 
Zero-rated supply
धारा 16 की उपधारा (3)
(3) A registered person making zero rated supply shall be eligible to claim refund under either of the following options, namely:—
(a) he may supply goods or services or both under bond or Letter of Undertaking, subject to such conditions,  safeguards and procedure as may be prescribed, without payment of integrated tax and claim refund of unutilised input tax credit; or
(b) he may supply goods or services or both, subject to such conditions, safeguards and procedure as may be  prescribed, on payment of integrated tax and claim refund of such tax paid on goods or services or both supplied,
in accordance with the provisions of section 54 of the Central Goods and Services Tax Act or the rules made thereunder.
     यहाँ क्लॉज (a) में बिना टैक्स दिए जीरो-रेटेड सप्लाइज करने की बात कही गयी है तथा क्लॉज (b) में टैक्स का भुगतान करने के बाद रिफंड लेने की बात कही गयी है।

     मेरा यह मानना है कि जिन सप्लाइज के सम्बन्ध में धारा 16 की उपधारा (3) बनाई गयी है वे सप्लाइज धारा 16 की उपधारा (1) में ज़ीरो-रेटेड सप्लाइज (Zero-rated supplies) घोषित कर दिए जाने पर सप्लाइज leviable to tax नहीं रह गयीं हैं।
