https://www.facebook.com/keshav.dayal.98/videos/2211883952177546/

CLAUSE (47) of SECTION 2 OF THE UPGST ACT
(47) "छूट प्राप्‍त प्रदाय" से ऐसे किसी माल या सेवाओं या दोनों का प्रदाय अभिप्रेत है, जिसकी, एकीकृत माल और सेवा कर अधिनियम की धारा 6 के अधीन कर की दर शून्‍य हो या जिसे धारा 11 के अधीन कर से पूरी छूट दी जा सकेगी और इसके अंतर्गत गैर-कराधेय प्रदाय भी है;
(47) “exempt supply” means supply of any goods or services or both which attracts nil rate of tax or which may be wholly exempt from tax under section 11, or under section 6 of the Integrated Goods and Services Tax Act, and includes non-taxable supply;
CLAUSE (47) of SECTION 2 OF CGST ACT
(47) “exempt supply” means supply of any goods or services or both which attracts nil rate of tax or which may be wholly exempt from tax under section 11, or under section 6 of the Integrated Goods and Services Tax Act, and includes non-taxable supply;
 (47) "छूट प्राप्‍त प्रदाय" से ऐसे किसी माल या सेवाओं या दोनों का प्रदाय अभिप्रेत है, जिसकी, एकीकृत माल और सेवा कर अधिनियम की धारा 6 के अधीन कर की दर शून्‍य हो या जिसे धारा 11 के अधीन कर से पूरी छूट दी जा सकेगी और इसके अंतर्गत गैर-कराधेय प्रदाय भी है;
      राज्यों और संघ के हिंदी में प्राविधान समान हैं।  इसी प्रकार राज्यों और संघ (Union) के अंग्रेजी भाषा में प्राविधान समान हैं किन्तु राज्यों में हिंदी और अंग्रेजी भाषा में परिभाषाओं में भिन्नता है। इसी प्रकार संघ (Union) के हिंदी और अंग्रेजी भाषा में परिभाषाओं में भिन्नता है।

HOW TO IDENTIFY AN EXEMPT SUPPLY OF GOODS

6. Liability to tax on inter-state sales.-
(1) Subject to the other provisions contained in this Act, every dealer shall, with effect from such date as the Central Government may, by notification in the Official Gazette, appoint, not being earlier than thirty days from the date of such notification, be liable to pay tax under this Act on all sales of goods (other than electrical energy) effected by him in the course of inter-State trade or commerce during any year on and from the date so notified:
         Provided that a dealer shall not be liable to pay tax under this Act on any sale of goods which, in accordance with the provisions of sub-section (3) of section 5, is a sale in the course of export of those goods out of the territory of India.
      यहां पर यह विचारणीय है कि संविधान की सातवीं अनुसूची की प्रथम सूची की प्रविष्टि 92A पार्लियामेंट को समाचारों की अंतर्राज्यीय बिक्री के सिवाय अन्य माल की अंतर्राज्यीय बिक्री पर कर लगाने का कानून बनाने का अधिकार देती है। अतः माल की अंतर्राज्यीय बिक्री पर कर लगाने का कानून, समाचार पत्रों की अंतर्राज्यीय बिक्री पर लागू नहीं होगा। इसके अतिरिक्त दो प्रकार के संव्यवहार उपर्युक्त उपधारा (1) से बाहर रखने का प्राविधान किया गया है :
(i) विद्युत् ऊर्जा की अंतर्राज्यीय बिक्री;
      चूंकि अधिनियम केवल केंद्रीय बिक्री (अंतर्राज्यीय बिक्री) पर लागू होता है अतः यह सभी प्रकार के माल की निम्नलिखित प्रकार की बिक्रियों पर लागू नहीं होता है:
1. माल की प्रान्त या यूनियन टेरिटरी के अंदर होने वाली बिक्री जिसमें फार्म एच के विरुद्ध बिक्री जो अधिनियम की धारा 5 की उपधारा (3) में निर्यात के दौरान बिक्री परिभाषित की गयी है भी शामिल है;
      ऐसी समस्त बिक्रियों जिन पर केंद्रीय बिक्री कर अधिनियम लागू नहीं होता को केंद्रीय बिक्री कर अधिनियम के अंतर्गत "sales not liable to tax under the Act" कहा जायेगा। ऐसी बिक्रियां जिन पर अधिनियम के अंतर्गत कर लग सकता है को "sales liable to tax under the Act" संदर्भित किया जायेगा। These sales may be referred to as the sales leviable to tax.
First kind of sales are exempt because they are not liable to tax under the Act, they are beyond the purview of the Act. Second type of sales are within the purview of Act but they are exempt because tax has not been levied on them. Though these sales prima facie are liable to tax yet they are not leviable to tax. (kindly note the difference in between "liable to tax" and "leviable to tax.")
"There is a broad distinction between the provisions contained in the statute in regard to the exemptions of tax or refund or rebate of tax on the one hand and in regard to the non-liability to tax or non-imposition of tax on the other. In the former case, but for the provisions as regards the exemptions or refund or rebate of tax, the sales or purchases would have to be included in the gross turnover of the dealer because they are prima facie liable to tax and the only thing which the dealer is entitled to in respect thereof is the deduction from the gross turnover in order to arrive at the net turnover on which the tax can be imposed. In the latter case, the sales or purchases are exempted from taxation altogether. The Legislature cannot enact a law imposing or authorising the imposition of a tax thereupon and they are not liable to any such imposition of tax. If they are thus not liable to tax, no tax can be levied or imposed on them and they do not come within the purview of the Act at all. The very fact of their non- liability to tax is sufficient to exclude them from the calculation of the gross turnover as well as the net turnover on which sales tax can be levied or imposed."
" This position is not at all affected by the provision with regard to registration and submissions of returns of the sales tax by the dealers under the Act. The legislature, in spite of its disability in the matter of the imposition of sales tax by virtue of the provisions of Art. 286 of the Constitution, may for the purposes of the registration of a dealer and submission of the returns of sales tax include these transactions in the dealer's turnover. Such inclusion, however, for the purposes aforesaid would not affect the non-liability of these transactions to levy or imposition of sales tax by virtue of the provisions of Art. 286 of the Constitution and the corresponding provision enacted in the Act, as above."
       माननीय उच्चतम न्यायालय द्वारा व्यक्त किये गए इस मत के आधार पर जीएसटी के मामले में सेन्ट्रल गुड्स एंड सर्विसेस टैक्स एक्ट और इंटीग्रेटेड गुड्स एंड सर्विसेस टैक्स एक्ट के अंतर्गत  कर मुक्त सप्लाई को भी समझा जा सकता है। अधिनियम के चार्जिंग सेक्शन (Tax Levy से सम्बंधित प्राविधान) से कोई सप्लाई कर योग्य प्रतीत होने के बाद भी कर मुक्त सप्लाई हो सकती है यदि अधिनियम के किसी अन्य प्राविधान में ऐसी सप्लाई पर सम्पूर्ण कर के भुगतान से छूट दी गयी है अथवा कर न लगाने का प्राविधान किया गया है अथवा कर की दर निल (NIL) या शून्य निर्धारित की गयी है। कर की दर निल (NIL) या शून्य कर देने से अदा किये जाने वाले कर (Tax) की धनराशि निल (NIL) या शून्य हो जाती है। ऐसी स्थिति में यह निष्कर्ष नहीं निकला जा सकता है कि कोई कर लगाया गया है।
       यह ध्यान देने योग्य है कि Central GST Act में taxable supply की परिभाषा अधिनियम के अंतर्गत राज्य के अंदर की जाने वाली कर योग्य सप्लाई के सन्दर्भ में दी गयी है किन्तु सकल टर्नओवर (aggregate turnover) और  करमुक्त सप्लाई (exempt supply) की परिभाषाएं Central GST Act और Integrated GST Act दोनों के सन्दर्भ में अखिल भारतीय स्तर पर (एक ही आयकर PAN रखने वाले सभी प्रतिष्ठानों द्वारा) किये जाने वाले सभी संव्यवहारों के सन्दर्भ में दीं गयीं हैं। इनमें दोनों अधिनियमों के अंतर्गत वे सप्लाइज भी शामिल की गयीं हैं जो दोनों अधिनियमों के अधिक्षेत्र के बाहर हैं।  ऐसा सकल टर्नओवर रजिस्ट्रेशन लेने अथवा न लेने का दायित्व तय करने के उद्देश्य से परिभाषित किया गया है। कुछ माल और सेवाओं पर कारोबारियों के कारोबार का स्तर देखते हुए कर से छूट या कर की दर निर्धारित करने में भी सकल टर्नओवर (aggregate turnover) की सहायता ली गयी है। किसी राज्य या संघ राज्य क्षेत्र में टर्नओवर (turnover in a State or turnover in a Union Territory) की परिभाषा सेन्ट्रल जीएसटी एक्ट (CGST Act) की धारा 2 के क्लॉज (112) में अलग से दी गयी है।
       कर मुक्त बिक्री या सप्लाई ऐसी बिक्री या सप्लाई है जिस पर कर आरोपणीय / उद्गृहणीय नहीं होता है (Sale or supply which is not chargeable/ leviable to tax).  इसके विपरीत कर योग्य बिक्री या सप्लाई ऐसी बिक्री या सप्लाई है जिस पर कर आरोपणीय / उद्गृहणीय होता है (sale or supply which is chargeable/leviable to tax). Central GST Act, 2017 की धारा 2 के क्लाज (108) में पद "taxable supply" निम्न प्रकार परिभाषित किया गया है।
(108) “taxable supply” means a supply of goods or services or both which is leviable to tax under this Act;

(108) "कराधेय प्रदाय" से ऐसे माल या सेवाओं या दोनों का प्रदाय अभिप्रेत है, जो इस अधिनियम के अधीन कर से उद्गृहणीय है ;

INVOLVEMENT OF TAX IN EXEMPT SALE OR SUPPLY

Friends!
Under VAT or GST system of payment of tax on sale or supply of goods or services, value of goods or services the sale or supply of which is exempt from tax, includes certain amount of tax already paid on goods and services utilised in manufacture or production of goods the sale or supply of which is exempt.

                We take example of Iodized salt. Sale or supply of salt is exempt from levy of tax. A manufacturer of Iodized salt need machinery, equipment, Iodine, packing material, etc. While making purchase of these things, manufacturer has to pay tax. Recovery of amount of tax, paid on purchase of these things, is also made from sale price of salt. Thus sale price of salt includes part of the amount of tax paid on things utilized in making salt and supply or sale of salt.

EXEMPT SUPPLY UNDER GST

      ये कर मुक्ति के उदहारण हैं। ऐसी स्थिति में सरकार को कोई राजस्व नहीं मिलता।  कर दाता को कर के रूप में कोई धनराशि अदा नहीं करनी पड़ती।
      ऊपर क्रमांक 5 पर अंकित जैसे प्राविधान,  जिसमें मुझे धनराशि जमा करनी होती है और बाद में जमा की गयी धनराशि मुझे लौटा दी जाती है, को माननीय उच्चतम न्यायालय द्वारा अवैध ठहराया गया है।
      कर लगाने से अभिप्राय  सरकार द्वारा जनता के प्रयोजनार्थ जनता से, कानून द्वारा प्रवर्तनीय तरीके से, धन की अनिवार्य उगाही से होता है।
      Central Goods and Services Tax Act, 2017 की धारा 2 के क्लॉज (108) में 'taxable supply' की परिभाषा निम्नप्रकार दी गयी है:-
(108) “taxable supply” means a supply of goods or services or both which is leviable to tax under this Act;
(108) "कराधेय प्रदाय" से ऐसे माल या सेवाओं या दोनों का प्रदाय अभिप्रेत है, जो इस अधिनियम के अधीन कर से उद्गृहणीय है ;
       माल या सेवाओं की कोई सप्लाई तभी 'leviable to tax' कही जा सकती है जब (1) ऐसी सप्लाई पर  कर लगाने की व्यवस्था अधिनियम में हो; (2) आगणित कर की धनराशि शून्य से अधिक कोई धनराशि हो और उसके सम्बन्ध में exemption / refund / rebate की सुविधा न दी गयी हो; तथा (3) कर की धनराशि की बसूली / अदायगी अनिवार्य रूप से की जानी हो।
       Levy of tax involves three important stages. First is declaration of levy; second is assessment of levy; and third is recovery of levy. In view of the above, except 'taxable supply', all other supplies made under GST are supplies exempt from levy of tax.

SUPPLY : THE TAXABLE EVENT IN GST

Friends!
            In GST, event for levy of tax is 'supply of goods or services or both' and not making of tax invoice or receipt of payment. Making of an agreement of supply of goods does not amount to supply of goods. Word "supply" denotes completed supply.
            In clause (12A) of article 366 of the Indian Constitution, expression "goods and services tax" has been defined as follows:
‘(12A) “goods and services tax” means any tax on supply of goods, or services or both except taxes on the supply of the alcoholic liquor for human consumption;’;
            In clauses 12 and   (26A), words, "goods" and "services" have been defined as follows:
(12) “goods” includes all materials, commodities, and articles;
‘(26A) “Services” means anything other than goods;
            We are concerned here with the meaning of the word "supply" used in the expression "supply of goods or services or both". Whether an agreement, made for supply of goods, amounts to supply of goods, is an important question. Where for supply of goods by one person to another, both persons enter into an agreement or contract of supply of goods, the contract of supply starts with making of the agreement. But by making only contract of supply, it cannot be concluded that event of supply of goods has taken place. Where a contract of supply of goods includes a condition of approval of goods by the recipient of goods, supply takes place at the moment at which recipient signifies its approval. If tax is leviable on the event of supply of goods, it cannot be levied before the event has taken place.  In case of tax on sale of goods, the Honorable Supreme Court has held that "sale" is to be understood a completed sale.
            In the business world, most of the contracts of supply of goods are contracts of sale. For all such cases, contract of "supply of goods" and contract of "sale of goods" are one and the same. In such cases, moment at which event of sale happens also becomes the moment at which supply of goods takes place. Event of entering into an agreement may be thought as an event initiating contract of supply of goods but cannot be considered happening of event of supply of goods. Similarly, event of payment or receipt of advance payment cannot be treated as happening of event of supply of goods. Under the contract of supply of goods, where contract of supply of goods is a contract of sale, event of supply cannot be treated a completed event unless control and possession over goods is made available to the recipient or his nominee.
            Section 7 of the Central Goods and Services Tax Act, 2017 (hereinafter referred to as the Central GST Act) defines scope of word "supply". Clause (a) of sub-section (1) of this section runs as follows:
"7. (1) For the purposes of this Act, the expression “supply” includes––
(a) all forms of supply of goods or services or both such as sale, transfer, barter, exchange, licence, rental, lease or disposal made or agreed to be made for a consideration by a person in the course or furtherance of business;"
            Here we see that a sale, transfer, barter, exchange, licence, rental, lease or disposal "agreed to be made for a consideration" has also been treated a supply of goods or services or both. In my opinion, in view of the discussion above, such provision is invalid also in view of the definition of the term "goods and services tax" provided in clause "26A" of article 366 of the Constitution.
            Section 12 of the Central GST Act, defines time of supply of goods for the purpose of payment of tax. Sub-sections (1) and (2) of this section run as under:
"12. (1) The liability to pay tax on goods shall arise at the time of supply, as determined in accordance with the provisions of this section.
(2) The time of supply of goods shall be the earlier of the following dates, namely:—
(a) the date of issue of invoice by the supplier or the last date on which he is required, under sub-section (1) of section 31, to issue the invoice with respect to the supply; or
(b) the date on which the supplier receives the payment with respect to the supply:
            Provided that where the supplier of taxable goods receives an amount up to one thousand rupees in excess of the amount indicated in the tax invoice, the time of supply to the extent of such excess amount shall, at the option of the said supplier, be the date of issue of invoice in respect of such excess amount.
Explanation 1.––For the purposes of clauses (a) and (b), “supply” shall be deemed to have been made to the extent it is covered by the invoice or, as the case may be, the payment.
Explanation 2.––For the purposes of clause (b), “the date on which the supplier receives the payment” shall be the date on which the payment is entered in his books of account or the date on which the payment is credited to his bank account, whichever is earlier."
            These provisions suggest that where payment is received or invoice is issued even before supply of goods, event will be considered to have taken place. This provision is creating lot of difficulties to traders and entrepreneurs.
            Receipt voucher details prescribed in the CGST Rules, also requires details of goods, their value, amount of tax, etc. There may be cases, in which value of goods may depend on circumstances prevailing on the day on which supply is made. In such circumstances, how the value of goods may be mentioned on the receipt voucher.
            In export cases, exporters are being required to furnish 'Letter of Undertaking' before goods can be exported.  Where an exporter fails to export goods within three months of making invoice, he has been required to make payment of Integrated Tax within fifteen days along with payment of interest at a rate of 18 percent per annum for the period commencing on the date of the invoice till the date on which payment is made. Important question is that whether preparation of invoice amounts to supply of goods.
            I fail to understand that if base or footing (नीव) of the building is slant or zig zag, how the wall of building may be vertical.
