FREEDOM BOUNDARIES

            Freedom is a good thing and we all love it. But it's domain is like open sky which has no limits. If we want to maintain and preserve our specific character, we, ourselves, will have to fix limits of our freedom and thereafter, we will have to protect those limits from our own encroachment and external aggression.

DEEMED EXPORTS UNDER GST

 Friends!
            Section 147 of the CGST ACT and SGST Act empower Central Government and State Governments to notify certain supplies of goods as "deemed exports". In my opinion, sections under both Acts are incomplete and useless.
            Section 147 of the Central Goods and Services Tax Act, 2017 runs as follows:
"147. The Government may, on the recommendations of the Council, notify certain supplies of goods as deemed exports, where goods supplied do not leave India, and payment for such supplies is received either in Indian rupees or in convertible foreign exchange, if such goods are manufactured in India."
          Since the section creates a legal fiction of treating an intra-State supply of goods as export, it requires purpose for which legal fiction has been created. Legal fiction can be created only for limited purpose. Secondly, section is silent about the effect of notified "deemed exports". Notified supply may be an exempt intra-State supply of goods as well as a taxable intra-State taxable supply of goods. After issue of notification, the important question will arise that whether the notified deemed export supply will be a taxable supply of goods or an exempt supply of goods. What benefits will be available to supplier of goods and the recipient of goods. In the normal course, benefit of input tax credit is not available to the supplier where supply of goods is an exempt supply. Where "deemed export" supply will be treated "exempt supply", a specific provision will be required to allow credit of input tax to the supplier in respect of inputs and input services utilised by him in making deemed export supply.
            Where exemption from tax will be given to supplier making deemed export supply, definition of expression "exempt supply" will also be disturbed. On the other hand if deemed export supply is not declared exempt from tax, purpose of notifying deemed exports will be defeated. Claim of credit of input tax by the recipient depends on mode of disposal of inputs by the recipient.
            A "taxable supply" is a supply of goods or services or both which is leviable to tax. All other supplies are "exempt supplies". Such exemption may be for two reasons:
(i) Supply is exempt because it is outside the purview of the Act; or
(ii) Supply is exempt because it attracts Nil rate (in reference to numbers NIL is zero) of tax or it is exempt from tax by virtue of any provision of the Act.
                Where an exempt supply of goods (supply referred to in clause (ii) above) will be notified "deemed export", if credit of input tax is not allowed to the supplier, value of deemed export will include amount of tax paid by the  supplier on inputs and input services, even if deemed supply is declared exempt supply. In such circumstances, recipient of supply who will utilise such supply in making "Zero rated supply" will not be in a position to make the export supply a zero rated supply (a supply value of which does not contain any element of tax) because the value of supply will contain amount of tax paid by supplier of deemed exports.
            Why deemed exports are being limited to supply of only those goods which are manufactured in India, is not clear. In my opinion, it may be extended to all goods.
            These are the reasons which compel me to think that section 147 of the CGST Act, as well as section 147 of the State GST Acts, is incomplete and unworkable.
            These issues cannot be solved under the rules because this is the part of the substantive law. I think that section could have, usefully, been drafted as follows:
147. (1) For facilitating business of export of goods or of services, the Government may, on the recommendations of the Council, notify certain supplies of goods as deemed exports, where goods supplied do not leave India, and payment for such supplies is received either in Indian rupees or in convertible foreign exchange.
(2) Where any supply of goods is notified a deemed export under sub-section (1), the supply shall be treated a supply exempt from tax and the supplier shall, subject to fulfillment of such conditions as may be prescribed, the supplier, -
(a) notwithstanding anything contained contrary to in any other provision of the Act, be entitled for claiming credit of input tax in his electronic credit ledger in respect of inputs and input services used in effecting such deemed export supply; and
(b) where amount of input tax credit referred to in clause (a) above cannot be utilized by him, be entitled to claim refund of unutilised amount of such input tax credit in accordance with provisions of section 54.
3. Without prejudice to any other action that may be taken under this Act or under any other law for the time being in force, where recipient of a deemed export supply fails to make use of the supply in the manner which entitles him to receive such supply without payment of tax, the recipient of the supply shall make payment of an amount which would have been payable on such supply by the supplier as tax, had such supply not been a deemed export supply and where the supply would have been a taxable supply otherwise, alongwith interest, at the rate of eighteen percent per annum, for the period commencing on date of invoice till the date of payment:
            Provided that where supply had been an exempt supply otherwise, the recipient shall pay an amount of tax computed applying the rates of tax on supply of inputs contained in the received supply alongwith interest, at the rate of eighteen percent per annum, for the period commencing on date of invoice till the date of payment.
4. Amount payable under sub-section (3) shall be added by the recipient of the deemed export supply in the output tax liability of the month in which recipient makes disposal of such supply or part of such supply.

5. Where a recipient, of deemed export supply which had been a taxable supply, makes payment of tax in accordance with sub-section (3), he can, subject to provisions of section 17, claim credit of input tax ledger in respect of such supply in his electronic credit.

Practical Approach Helps

Good Morning Friends !

HOW TO IDENTIFY AN EXEMPT SUPPLY OF GOODS

6. Liability to tax on inter-state sales.-
(1) Subject to the other provisions contained in this Act, every dealer shall, with effect from such date as the Central Government may, by notification in the Official Gazette, appoint, not being earlier than thirty days from the date of such notification, be liable to pay tax under this Act on all sales of goods (other than electrical energy) effected by him in the course of inter-State trade or commerce during any year on and from the date so notified:
         Provided that a dealer shall not be liable to pay tax under this Act on any sale of goods which, in accordance with the provisions of sub-section (3) of section 5, is a sale in the course of export of those goods out of the territory of India.
      यहां पर यह विचारणीय है कि संविधान की सातवीं अनुसूची की प्रथम सूची की प्रविष्टि 92A पार्लियामेंट को समाचारों की अंतर्राज्यीय बिक्री के सिवाय अन्य माल की अंतर्राज्यीय बिक्री पर कर लगाने का कानून बनाने का अधिकार देती है। अतः माल की अंतर्राज्यीय बिक्री पर कर लगाने का कानून, समाचार पत्रों की अंतर्राज्यीय बिक्री पर लागू नहीं होगा। इसके अतिरिक्त दो प्रकार के संव्यवहार उपर्युक्त उपधारा (1) से बाहर रखने का प्राविधान किया गया है :
(i) विद्युत् ऊर्जा की अंतर्राज्यीय बिक्री;
      चूंकि अधिनियम केवल केंद्रीय बिक्री (अंतर्राज्यीय बिक्री) पर लागू होता है अतः यह सभी प्रकार के माल की निम्नलिखित प्रकार की बिक्रियों पर लागू नहीं होता है:
1. माल की प्रान्त या यूनियन टेरिटरी के अंदर होने वाली बिक्री जिसमें फार्म एच के विरुद्ध बिक्री जो अधिनियम की धारा 5 की उपधारा (3) में निर्यात के दौरान बिक्री परिभाषित की गयी है भी शामिल है;
      ऐसी समस्त बिक्रियों जिन पर केंद्रीय बिक्री कर अधिनियम लागू नहीं होता को केंद्रीय बिक्री कर अधिनियम के अंतर्गत "sales not liable to tax under the Act" कहा जायेगा। ऐसी बिक्रियां जिन पर अधिनियम के अंतर्गत कर लग सकता है को "sales liable to tax under the Act" संदर्भित किया जायेगा। These sales may be referred to as the sales leviable to tax.
First kind of sales are exempt because they are not liable to tax under the Act, they are beyond the purview of the Act. Second type of sales are within the purview of Act but they are exempt because tax has not been levied on them. Though these sales prima facie are liable to tax yet they are not leviable to tax. (kindly note the difference in between "liable to tax" and "leviable to tax.")
"There is a broad distinction between the provisions contained in the statute in regard to the exemptions of tax or refund or rebate of tax on the one hand and in regard to the non-liability to tax or non-imposition of tax on the other. In the former case, but for the provisions as regards the exemptions or refund or rebate of tax, the sales or purchases would have to be included in the gross turnover of the dealer because they are prima facie liable to tax and the only thing which the dealer is entitled to in respect thereof is the deduction from the gross turnover in order to arrive at the net turnover on which the tax can be imposed. In the latter case, the sales or purchases are exempted from taxation altogether. The Legislature cannot enact a law imposing or authorising the imposition of a tax thereupon and they are not liable to any such imposition of tax. If they are thus not liable to tax, no tax can be levied or imposed on them and they do not come within the purview of the Act at all. The very fact of their non- liability to tax is sufficient to exclude them from the calculation of the gross turnover as well as the net turnover on which sales tax can be levied or imposed."
" This position is not at all affected by the provision with regard to registration and submissions of returns of the sales tax by the dealers under the Act. The legislature, in spite of its disability in the matter of the imposition of sales tax by virtue of the provisions of Art. 286 of the Constitution, may for the purposes of the registration of a dealer and submission of the returns of sales tax include these transactions in the dealer's turnover. Such inclusion, however, for the purposes aforesaid would not affect the non-liability of these transactions to levy or imposition of sales tax by virtue of the provisions of Art. 286 of the Constitution and the corresponding provision enacted in the Act, as above."
       माननीय उच्चतम न्यायालय द्वारा व्यक्त किये गए इस मत के आधार पर जीएसटी के मामले में सेन्ट्रल गुड्स एंड सर्विसेस टैक्स एक्ट और इंटीग्रेटेड गुड्स एंड सर्विसेस टैक्स एक्ट के अंतर्गत  कर मुक्त सप्लाई को भी समझा जा सकता है। अधिनियम के चार्जिंग सेक्शन (Tax Levy से सम्बंधित प्राविधान) से कोई सप्लाई कर योग्य प्रतीत होने के बाद भी कर मुक्त सप्लाई हो सकती है यदि अधिनियम के किसी अन्य प्राविधान में ऐसी सप्लाई पर सम्पूर्ण कर के भुगतान से छूट दी गयी है अथवा कर न लगाने का प्राविधान किया गया है अथवा कर की दर निल (NIL) या शून्य निर्धारित की गयी है। कर की दर निल (NIL) या शून्य कर देने से अदा किये जाने वाले कर (Tax) की धनराशि निल (NIL) या शून्य हो जाती है। ऐसी स्थिति में यह निष्कर्ष नहीं निकला जा सकता है कि कोई कर लगाया गया है।
       यह ध्यान देने योग्य है कि Central GST Act में taxable supply की परिभाषा अधिनियम के अंतर्गत राज्य के अंदर की जाने वाली कर योग्य सप्लाई के सन्दर्भ में दी गयी है किन्तु सकल टर्नओवर (aggregate turnover) और  करमुक्त सप्लाई (exempt supply) की परिभाषाएं Central GST Act और Integrated GST Act दोनों के सन्दर्भ में अखिल भारतीय स्तर पर (एक ही आयकर PAN रखने वाले सभी प्रतिष्ठानों द्वारा) किये जाने वाले सभी संव्यवहारों के सन्दर्भ में दीं गयीं हैं। इनमें दोनों अधिनियमों के अंतर्गत वे सप्लाइज भी शामिल की गयीं हैं जो दोनों अधिनियमों के अधिक्षेत्र के बाहर हैं।  ऐसा सकल टर्नओवर रजिस्ट्रेशन लेने अथवा न लेने का दायित्व तय करने के उद्देश्य से परिभाषित किया गया है। कुछ माल और सेवाओं पर कारोबारियों के कारोबार का स्तर देखते हुए कर से छूट या कर की दर निर्धारित करने में भी सकल टर्नओवर (aggregate turnover) की सहायता ली गयी है। किसी राज्य या संघ राज्य क्षेत्र में टर्नओवर (turnover in a State or turnover in a Union Territory) की परिभाषा सेन्ट्रल जीएसटी एक्ट (CGST Act) की धारा 2 के क्लॉज (112) में अलग से दी गयी है।
       कर मुक्त बिक्री या सप्लाई ऐसी बिक्री या सप्लाई है जिस पर कर आरोपणीय / उद्गृहणीय नहीं होता है (Sale or supply which is not chargeable/ leviable to tax).  इसके विपरीत कर योग्य बिक्री या सप्लाई ऐसी बिक्री या सप्लाई है जिस पर कर आरोपणीय / उद्गृहणीय होता है (sale or supply which is chargeable/leviable to tax). Central GST Act, 2017 की धारा 2 के क्लाज (108) में पद "taxable supply" निम्न प्रकार परिभाषित किया गया है।
(108) “taxable supply” means a supply of goods or services or both which is leviable to tax under this Act;

(108) "कराधेय प्रदाय" से ऐसे माल या सेवाओं या दोनों का प्रदाय अभिप्रेत है, जो इस अधिनियम के अधीन कर से उद्गृहणीय है ;
